The Digital Services Act A Framework to Protect Users from Platform Dominance
On January 20, 2022, MEPs (Members of the European Parliament) agreed on a set of proposed measures to address unlawful material, hold platforms accountable for their algorithms, and enhance content moderation.
The resolution, which was passed by Parliament today by a vote of 530 to 78, with 80 abstentions, will serve as the basis for negotiations with the French president of the Council, which will represent member states.
The DSA outlines a "notification and enforcement" procedure for the removal of illicit items, services, or content from the internet, as well as protections. Stricter measures are also inserted to guarantee that notifications are treated in a non-discriminatory and non-arbitrary, while still respecting fundamental rights, such as freedom of speech.
Abstaining micro and small businesses from certain DSA obligations, targeted advertising, redress for any damages caused by platforms failing to meet their due diligence obligations, and online media barred from using intentionally misleading techniques to influence users are among the changes made by Parliament to the Commission proposal.
Due to the unique threats they offer regarding the distribution of both unlawful and harmful information, extensive online platforms (VLOPs) will be subject to additional requirements.
The resolution represents a significant step towards ensuring that all EU citizens benefit from a more attractive and accessible online environment, which is essential to encourage consumer spending, employment, and economic growth.
